naijabs.top (Nigeria) Terms and Conditions

These Terms and Conditions (the “Terms”) apply to your use as a Nigerian user of naijabs.top’s website, mobile application, and fresh food delivery service (collectively, the “Services”). By accessing or using our Services, you agree to comply with these Terms, the Nigerian Consumer Protection Commission Act (CPC Act), the Nigerian Data Protection Regulations 2019 (NDPR), and other applicable local laws. If you do not agree to these Terms, please do not use our Services.

1. Eligibility to Use Our Services

To use naijabs.top's services, you must:

Be 18 years of age or older (if you are under 18, you need the consent of your parent/guardian, who must accept these terms on your behalf);

Provide accurate, complete, and up-to-date information (such as name, address, and phone number) when creating an account or placing an order;

Reside within our designated delivery area (see our "Delivery Information" page for details);

Use our services only for personal, non-commercial purposes (commercial or bulk orders require prior written approval from naijabs.top).

2. Account Registration and Security

Creating an Account: You can register an account to track orders and save your shipping address. You are responsible for maintaining the confidentiality of your account password and login information.

Account Liability: If you suspect your account has been accessed without authorization, you agree to notify us immediately (via newmanbomo@gmail.com). We are not liable for any loss or damage caused by your failure to protect your account security.

Information Accuracy: You must update your account information promptly (e.g., changes to address or phone number). We are not responsible for delivery delays, order omissions, or errors caused by outdated information.

3. Placing an Order and Confirmation

a. How to Place an Order

Browse our product catalog, add items to your cart, and proceed to checkout. Before submitting your order, please carefully check the order details (items, quantity, shipping address, and payment method).

All prices are displayed in Nigerian Naira (NGN) and include applicable taxes (e.g., VAT). Prices are subject to change without notice, but we will charge the price shown when you place your order (unless the item is out of stock or the pricing is incorrect – see Section 3c).

b. Order Confirmation

After submitting your order, you will receive an email/SMS/WhatsApp confirmation containing your order number, estimated delivery time, and order summary. This confirmation does not constitute final confirmation of your order – we reserve the right to accept or reject orders (e.g., in case of out-of-stock items or payment failure).

If we are unable to fulfill your order (e.g., due to insufficient stock), we will notify you within 1 hour of you submitting your order. If the order is rejected, the payment will be refunded within 3-5 business days (the exact amount depends on your payment method).

c. Pricing Errors and Out-of-Stock Items

In case of pricing errors (e.g., incorrect product price), we will contact you to confirm whether you wish to continue purchasing at the correct price or cancel the order (and receive a full refund).

If you find a product is out of stock after placing your order, we will:

Provide a suitable alternative at the same price (e.g., similar brand rice or oil); or

Refund the out-of-stock item to your original payment account.

We will notify you of the alternative or out-of-stock situation by phone/WhatsApp before shipment. If we are unable to contact you, we will choose Option 2 (refund) and include an explanation in your order.

4. Payment Methods

We accept the following payment methods (all priced in Nigerian Naira):

Mobile Wallets: Flutterwave, Paystack, Opay, Palmpay (instant payment processing – you will receive a receipt upon confirmation). Bank Transfer: GTBank, Access Bank, Zenith Bank, First Bank (Please include your order number in the transfer remarks to avoid delays).

Cash on Delivery (COD): Applicable to orders under 50,000 Nigerian Naira. You must pay the exact amount in cash upon receipt – no change will be given by the delivery person.

Payment Security and Refunds

We use payment processors compliant with NDPR and PCI DSS standards to protect your payment information (we never store complete bank card information on our servers).

For cancelled orders, out-of-stock items, or damaged goods, refunds will be processed within 3-5 business days. Specific refund arrival times are as follows:

Mobile Wallet: 1-2 business days;

Bank Transfer: 3-5 business days;

Cash on Delivery: Not applicable.

5. Delivery Terms

Our delivery terms are detailed on the "Delivery Information" page, but key points include:

Delivery Time Slot: You must remain at the designated delivery address during your selected time slot. If no one is available to receive your order, we will:

Attempt to contact you for 30 minutes;

Leave the order at your doorstep (if you selected contactless delivery); or

Reschedule delivery for the next available time slot (a resale fee of 500 Nigerian Naira will apply, unless the delay is due to our error).
